Littleton Board of Health Grants Four Votes, Approves Irrigation Well Deed Restriction

LITTLETON — November 29, 2023 — Littleton Board of Health approves septic variances at two properties and navigates disputed well status at a third. The board voted unanimously to grant Title V variances at 26 Concord Drive — allowing a sieve analysis in lieu of a percolation test and a two-foot groundwater offset with a Presby system — and at 15 George Street, where engineer Kirk Patrick of Civil Solutions won approval for a sieve analysis, a four-to-two-foot groundwater offset, and a less-than-12-inch tank separation variance for a geomat leaching system serving property owner Anne Rothwell. The most contested item involved a drilled well at 4 Foss Place that a builder had capped but not fully decommissioned as required by the original Title V plan; Board of Health Agent Jim Griffey said the capped casing "isn't properly decommissioned and it's not active and permitted for use." The board voted 3-1 — member Matt Wason dissenting — to designate the well as irrigation-only and require a deed restriction using template language from the town of Lunenburg, allowing the buyers to proceed to closing. The board also continued a public hearing for 23-31 Stevens Street and paused work on draft private well regulations pending input from the Agricultural Commission and two residents who submitted detailed written comments.
