Littleton Conservation Commission Unanimously Ratifies Two Wetland Enforcement Orders

LITTLETON — January 17, 2023 — Littleton Conservation Commission issues two enforcement orders over unpermitted wetland-area tree clearing. The commission voted unanimously at its January 17 meeting to ratify enforcement orders against Diane Thompson of Warrington, Oregon, and Mark Gallagher of Seal Harbor, Acton, both tied to tree cutting near flagged wetlands off Ipswich Drive and Foss Place, a paper road discovered after a tip from the town's code enforcer. Conservation agent Amy said Gallagher, who owns one parcel and has a second under purchase agreement, called her after the orders were issued and said, "mea culpa — he didn't realize what he was doing," while engineer Sue Carter similarly acknowledged insufficient site oversight. Carter's survey crew was tasked with cataloging stumps by diameter and species and surveying the full extent of clearing, with results due February 7. Separately, the commission voted unanimously to issue a negative determination for a building addition at 70 Mill Road for Hollywood Interiors, conditioned on plan revisions shifting erosion controls closer to the construction area, and continued three residential notices of intent — at 29 Lakeshore Drive, 107 Mattawanake Road, and 35 Queen Street — each with substantive outstanding questions on stormwater management, waiver language, and wetland proximity.
